New regulations in Thailand! Thai airlines can refuse to carry passengers who do not meet the requirements

Civil Aviation Resources Network, January 24, 2025: According to Thai headlines, Thai media reported that on January 23, the Civil Aviation Authority of Thailand announced that the Civil Aviation Committee of Thailand, chaired by Thailand's Deputy Prime Minister and Minister of Transport Suriya, issued new regulation No. 104, which stipulates eight situations in which airlines can refuse to carry passengers to protect the rights of passengers. The regulation will take effect from February 19, 2025, and the specific content is as follows:
1. Passengers who need special assistance: If the passenger fails to notify the airline of the need for special assistance in advance within the time specified by the airline, and the airline has made every effort to provide appropriate facilities to ensure the passenger's safe travel, but still cannot meet the passenger's special needs, the airline has the right to refuse to carry the passenger;
2. Passengers who fail to produce valid travel documents: If the passenger cannot produce a valid identity verification document issued by a government agency, or cannot provide the necessary transit and entry permit documents, the airline has the right to refuse to carry the passenger;
3. Entry restrictions of the destination or stopover country: If the immigration department of the destination country or stopover country notifies the airline that the passenger is not allowed to enter or stay, the airline has the right to refuse to carry the passenger;
4. Infants under 14 days old;
5. Children under 5 years old traveling alone;
6. Pregnant women who have exceeded the gestation period specified by the airline;
7. Passengers who fail to pass or do not cooperate with security checks;
8. Circumstances where transportation is refused for safety and security reasons.
The regulation is based on Aviation Law No. 2497 and its amendment, Article 41/133 of the Aviation Law (Amendment No. 14), and aims to protect the rights of passengers and ensure the implementation of flight safety and security standards.
