On June 23, the Legal Affairs Commission of the Standing Committee of the National People's Congress held a press conference. Huang Haihua, spokesman of the Legal Affairs Commission, introduced the second review draft of the Civil Aviation Law Amendment. In February 2025, the 14th Standing Committee of the National People's Congress conducted its first review of the draft amendment to the Civil Aviation Law. During the revision of the draft, we carefully sorted out and studied the suggestions put forward by Xiang Qiao, She Caigao, Huang Li, Ma Guodong and other National People's Congress deputies on legislation to promote the development of the aviation industry and low-altitude economy, strengthen my country's aviation safety work, and improve the supervision of civil drones, and fully absorbed and adopted the practical suggestions.
Based on the opinions of all parties, the second review draft of the revised draft is proposed to make the following major revisions: First, enrich the measures to promote the development of civil aviation, especially the content of promoting the development of civil aviation manufacturing industry and low-altitude economy. Second, it stipulates that the civil aviation department of the State Council shall issue relevant civil aviation regulations. Third, improve the relevant content of ensuring civil aviation safety. Fourth, improve the format clauses of passenger transportation contracts and flight delay service guarantee related content, and further strengthen the protection of passenger rights and interests. Fifth, in terms of carrier compensation liability, do a good job in connecting with relevant international conventions. Sixth, according to the practice over the years and the need to promote high-level opening up, increase the provisions for opening up air rights.
A reporter asked that in recent years, the manufacturing and operation of domestic large aircraft such as C919 have made great achievements, and the development of low-altitude economy in some cities is in the ascendant. But at the same time, according to relevant reports, there are also some shortcomings in my country's aircraft manufacturing industry, aircraft airworthiness certification, and low-altitude economic infrastructure construction. Will the draft revision of the Civil Aviation Law reviewed by the Standing Committee this time make targeted revisions and improvements?
Huang Haihua said that in the 30 years since the promulgation of the Civil Aviation Law, my country's civil aviation R&D and manufacturing capabilities have been continuously enhanced, the scale of the transportation market has been continuously expanded, and the low-altitude economy has flourished. All parties suggested that the revision of the Civil Aviation Law should implement the decisions and arrangements of the Party Central Committee on the high-quality development of civil aviation and enrich the measures to promote the development of my country's civil aviation industry to a higher level. According to the actual development of my country's civil aviation industry and suggestions from relevant parties, the second draft of the revised draft of the Civil Aviation Law specifically adds a chapter on "development promotion" and improves relevant clauses: First, it adds provisions that the state improves the innovation system of the civil aviation manufacturing industry with enterprises as the main body, market-oriented, and combining production, education and research, supports the research and development of key core technologies, improves the research and development and design capabilities of large aircraft and advanced engines, promotes the industrialization of scientific and technological innovation results, and promotes the development of the civil aviation manufacturing industry. Second, it adds provisions that the state improves the organization system and standard specifications for airworthiness certification of civil aircraft, strengthens the training of airworthiness certification talents, establishes and improves the risk-based classification and grading airworthiness management method, and improves the airworthiness certification capabilities and levels. Third, it adds provisions to improve the layout of civil airports, accelerate the construction of civil aviation hubs, and build a wide-coverage, high-quality and efficient civil aviation service system. Fourth, it adds provisions that the state takes measures to optimize the allocation of low-altitude airspace resources, promote the construction of a civil low-altitude flight-related service supervision platform, establish and improve airworthiness certification, flight management and other systems and standards that meet the requirements of low-altitude economic development, expand the application service field, and promote the development of low-altitude economy. Fifth, the content of promoting international cooperation, commendation and rewards in the field of civil aviation is added. A reporter asked, at present, the ticket sales format terms of civil aviation enterprises, flight delays and cancellations, etc. are increasingly concerned and discussed by consumers. Does the draft revision of the Civil Aviation Law have targeted provisions for these specific issues in the protection of passenger rights?
Huang Haihua said that during this revision process, we conducted focused research and listened to the opinions and suggestions of relevant parties. The draft revision of the Civil Aviation Law reviewed by the Standing Committee in February this year has a special section on "passenger rights protection", which clearly stipulates that public air transport enterprises must publish their general transportation conditions and other format terms and clearly inform passengers, stipulate that when flights are delayed or cancelled, they must promptly release information notices and provide good passenger services, and also make specific provisions for the acceptance, handling and feedback of complaints. On this basis, the second draft of the revised draft submitted to this Standing Committee meeting for review has been further revised and improved: First, the requirements for improving the quality of civil aviation services have been added to the general provisions. Second, in the content that should be included in the standard terms such as the general conditions of transportation, "passenger ticket sales, refunds and changes, boarding, and luggage transportation" are added to further protect the passengers' right to know and right to choose. Third, when the flight is delayed or cancelled, the public air transport enterprises and transport airport operators should change the "catering" arrangements for passengers to "food and lodging" arrangements.
It should be pointed out that the Civil Code has made clear provisions on the principles that the standard terms should follow, the obligation to provide prompts and explanations, invalid situations, and the principles of interpretation. The Consumer Protection Law has made provisions on the rights of consumers to know, choose, and trade fairly, as well as the obligations of operators. Departmental regulations such as the "Regulations on Normal Flight Management" and the "Regulations on Passenger Service Management for Public Air Transport" also have clear requirements for flight delay handling, passenger services, and complaint management. When providing services to passengers, public air transport enterprises and airport operators should abide by the provisions of relevant laws and regulations and effectively safeguard the legitimate rights and interests of passengers.
