On December 15, 2025, Civil Aviation Resource Network reported that the U.S. Department of Transportation (DOT) recently stated that airlines whose flights were delayed or canceled last month due to an emergency government directive to upgrade Airbus A320 aircraft software will not be required to provide affected passengers with hotels, meals, or other compensation.

Previously, major U.S. airlines had pledged to provide such compensation if flight cancellations or severe delays were due to factors within their control.

The DOT stated that the Airbus A320 issue-which, according to the Federal Aviation Administration (FAA) directive, required immediate action-did not trigger this obligation.

Recent in-flight incidents involving a JetBlue A320 aircraft exposed its vulnerability to solar flares, prompting airlines to race to complete software updates, resulting in the cancellation or delay of hundreds of flights during the U.S. Thanksgiving holiday.

In a notification dated December 9, the DOT stated that going forward, "for flight cancellations or prolonged delays caused by unplanned maintenance required by airworthiness directives, if the maintenance cannot be postponed or must be completed before the flight's departure, such cancellations or delays will not be considered as being caused by factors within the airline's control."

The Trump administration also plans to develop new rules to alleviate what it calls the regulatory burden on airlines and ticket agents. These new rules will detail the definition of flight cancellations (i.e., situations where consumers are entitled to a refund) and re-examine regulations regarding ticket pricing and advertising.
